Terms of Service
These Terms govern your use of Icarus game server hosting. By creating an account or using the service, you agree to these Terms, our Privacy Policy and our Acceptable Use Policy.
1. The service
We provide game server hosting for Minecraft and the other games we list, the panel to manage your servers, and features such as two vaults per plan where offered. Features may change. We work in good faith to keep the service available, but it is provided on a best-effort basis: these Terms make no uptime guarantee, and none applies unless we publish a separate service level agreement.
2. Accounts
Keep your sign-in details confidential. You are responsible for activity under your account. Give us accurate information.
3. Plans, sizing and vaults
We recommend an amount of RAM from what you plan to install and how many players you expect. That recommendation is guidance, not a promise that every modpack runs well on every plan; if what you install needs more than your plan has, we may warn you or ask you to upgrade. Switching to another modpack or game keeps the same server address and plan where we advertise it, but it does not resize your plan, so a heavier pack may need more RAM. You must follow each game’s end-user license agreement, including Mojang’s and Microsoft’s for Minecraft.
4. Acceptable use
You must follow our Acceptable Use Policy, which covers illegal content, network abuse and attacks, malware, unauthorized mining, license violations and more. We may suspend or terminate service for breaking it.
5. Billing, refunds and codes
Prices are as shown at checkout; taxes may be added. Subscriptions renew until you cancel. You can get a refund within 3 days of your first purchase by asking support, provided the account hasn’t been used abusively. Opening a chargeback without contacting us first may lead to suspension. Creator and promo codes give the discount, and carry the terms, published for that code; a code does not let you run a modpack on a plan below its recommended size.
6. Content and backups
You are responsible for having the rights to the games, mods and other content you install, and for keeping your own backups of worlds you care about. After your service ends we may delete its data in line with our retention practices, so export what you need first.
7. Suspension and termination
We may suspend or terminate service for a breach of the Acceptable Use Policy, nonpayment, legal risk, or to protect the platform and other customers. You may cancel at any time; access generally continues until the end of the period you paid for unless we terminate for cause.
8. Disclaimers
The service is provided “as is.” To the fullest extent the law allows, we disclaim warranties of merchantability, fitness for a particular purpose and non-infringement.
9. Limitation of liability
To the fullest extent the law allows, our total liability for any claim relating to the service is limited to what you paid us in the 3 months before the claim. We are not liable for indirect, incidental, special or consequential damages, lost profits, or lost worlds or data, except where the law does not allow that limit.
10. Indemnity
You will defend and indemnify us against claims arising from your content, the use of your servers, or your breach of these Terms, the Acceptable Use Policy or a game’s license agreement.
11. Governing law
These Terms are governed by Texas law, excluding its conflict-of-law rules. Disputes go to the courts of Harris County, Texas, unless the law requires otherwise.
12. Changes
We may update these Terms by posting a new version on this page. Using the service after the new effective date means you accept it. We may also email you about material changes.
